Court of Appeal finds proscription of Palestine Action lawful

On 15 June 2026, a five-member Court of Appeal presided over by the Lady Chief Justice and including the Master of the Rolls, held that the Home Secretary’s decision to proscribe Palestine Action was lawful, overturning the judgment of a three-member Divisional Court. The Court of Appeal found that the Divisional Court was wrong to conclude that the Home Secretary failed to comply with her own policy when making the decision to proscribe Palestine Action and that her decision was proportionate as it struck a fair balance between the Article 10 and 11 rights of individuals on the one hand, and the interests of the community on the other.
