Supreme Court overturns 20-year precedent and refuses extradition for insider dealing

In a watershed ruling, the Supreme Court today refused a request by the United States for the extradition of Mr Joseph El-Khouri on allegations of insider dealing where the conduct alleged took place primarily in the United Kingdom but was said to impact United States stock markets. In doing so, the Supreme Court overturned the House of Lords precedent in Cando Armas  [2005] UKHL 67, holding that it was not sufficient that ‘effects’ of the conduct alleged were felt in the requesting state.

Clair Dobbin KC and Ciju Puthuppally acted for the Appellant, Mr El-Khouri.
