Court of Appeal overturn the conviction of a serving police officer

The Court of Appeal has quashed an assault conviction of a serving police officer. Kevin Baumber and Kiera Oluwunmi appeared on behalf of the Appellant and in the process helped establish the principle that it is a ‘short step’ from concluding that bad character fresh evidence would have been admissible under s100(1)(b) CJA 2003 to concluding that such evidence would have materially weakened the prosecution case in an appeal against conviction. The Court of Appeal also extended the line of authority on later events establishing an earlier propensity in relation to habitual drug use.
