The Secretary of State for Work and Pensions successfully appeals whether the administration of the childcare element of universal credit is discriminatory to women or irrational

Clair Dobbin QC and Ruth Kennedy (11 KBW) acted for the Secretary of State for Work and Pensions in her successful appeal on the question of whether the way the childcare element of Universal Credit was indirectly discriminatory and irrational.

In R (on the application of Salvato) v Secretary of State for Work and Pensions [2021] EWCA Civ 1482 the Court of Appeal (the Vice President, Andrews LJ and Warby LJ) allowed the Secretary of State’s appeal and set aside the declarations made by Chamberlain J.
