UK extradition reference to Court of Justice of the European Union

On 27 January 2021 Helen Malcolm QC led Joshua Kern in a Preliminary Reference from a court in England and Wales to the Court of Justice of the European Union in Luxembourg, in relation to the existence of proper defence safeguards in Bulgarian extradition requests under the EAW system.

On 11th February, the Advocate General endorsed the arguments of Helen Malcolm QC and Joshua Kern in their Preliminary Reference to the CJEU in Luxembourg. Today, 11th March, the CJEU ruled that Bulgaria can no longer seek extradition of anyone for trial from any EU Member State.
