Following a trial at Winchester County Court, HHJ Hughes QC found that a former police officer had been unlawfully arrested for possession of indecent images. In giving his judgment the court stated that the classification of the images as indecent was “absurd” and the “whole police process from the assessment of the images onwards was tainted with high handedness, oppression, an absence of independent judgment and, on the part of (the arresting officer) malice.”
Robert Morris acted for the successful claimant.
