Teenager wins ruling on detention of 17 year olds

In a test case brought by a south London teenager against both the Secretary of State for the Home Department and the Commissioner of Police for the Metropolis, it was held that Home Secretary’s failure to review Code C PACE 1984 in respect of 17 year olds in custody represented a breach of Article 8 of the European Convention on Human Rights, and she has been ordered to redraft the Code. The claim did not succeed against the Metropolitan Police.
