Hugo Keith QC and Clair Dobbin in successful Article 2 judicial review

Hugo Keith QC and Clair Dobbin acted for the successful claimant in a judicial review of the decision by the Metropolitan Police Service not to permit him to resign during the currency of an investigation into the death of Sean Rigg. The police officer who had been involved in the restraint of Sean Rigg sought to resign in order to pursue his vocation as a priest. In this important Judgment, on the requirements of Article 2, Mr Justice Garnham, quashing the decision, concluded that Article 2 did not require there to be a misconduct process.
