A district judge at Westminster Magistrates’ Court has refused a request for extradition from Brazil, on the basis that extradition would breach the requested person’s rights under Article 3 ECHR. The defendant had been convicted in his absence of offences of drug smuggling, and sentenced to over 9 years’ imprisonment. The court heard evidence that prison conditions in Rio de Janeiro fell far short of meeting international standards and were “uniformly appalling”.
